KUALA LUMPUR: The complainant in Datuk Seri Anwar Ibrahim’s sodomy trial, Mohd Saiful Bukhari Azlan had said that there was penetration, despite his medical proforma stating that it was “rectal attempted”, a doctor told the High Court.

Forensic pathologist Dr Razuin Rahimi, who is now based in Hospital Sg Buloh, told the court Wednesday that she had interviewed Mohd Saiful at Hospital Kuala Lumpur, prior to his medical examination there on June 28, 2008.

During her examination-in-chief by Solicitor-General II Datuk Mohd Yusof Zainal Abiden, she was asked why she had circled “Yes” for “rectal attempted”, to which she replied: “This line is a little confusing, because I wouldn’t know whether it reached the rectum (during penetration).

“If there was a line that said ‘anus performed’, I would have circled that.”

Later, during her cross-examination by defence counsel Karpal Singh, she disagreed that rectal penetration was the same as anal penetration, which amounted to sodomy.

KUALA LUMPUR, 7 Mac — The Royal Commission of Inquiry into the death of Teoh Beng Hock was told today that no information on short messaging service (SMS) and calls made, received or missed on the day the political aide was found dead could be retrieved from the handphones belonging to six Malaysian Anti-Corruption Commission (MACC) officers.

An assistant analyst at the computer crime section of the Royal Malaysian Police forensic laboratory, Inspector Mohd Zaidi Abu Hassan, said the information that was available in the telephones were those made and received after July 22, 2009.

The information on the important dates, like July 15, 16 and 17, 2009, could not be detected, due to the limited storage of data in the telephone or because the telephones were new, he added.

Mohd Zaidi was given five handphones belonging to Hairul Ilham Hamzah, Azim Hafiz Jamaluddin, Mohd Asraf Mohd Yunos, Mohd Anuar Ismail and Mohd Nadzri Ibrahim to be analysed on July 23, 2009.

However, he said he was only able to analyse four of the handphones because the one belonging to Mohd Nadzri had a “PIN lock key”.

On August 13, 2009, Mohd Zaidi was given two handphones belonging to Selangor MACC deputy director Hishamuddin Hashim to be analysed, but found that they also did not have the information on the dates requested (July 15,16 and 17).

Earlier, Mohd Zaidi told the commission that he used the “XRY” software to detect the information from all the handphones.

Teoh, 30, who was the political aide of Selangor executive councillor Ean Yong Hian Wah, was found dead on the fifth floor corridor of Plaza Masalam in Shah Alam on July 16, 2009, after being questioned overnight at the Selangor Malaysian Anti-Corruption Commission (MACC) office on the 14th floor.

Prime Minister Datuk Seri Najib Razak ordered the setting up of the commission on January 25 this year to investigate into Teoh’s death after the Coroner’s Court returned an open verdict on the case.

The commission is chaired by Federal Court judge Tan Sri James Foong Cheng Yuen, while the members comprise former Federal Court judge Datuk Abdul Kadir Sulaiman, former Appeal Court judge Datuk T. Selventhiranathan, Penang Hospital’s forensic pathologist Datuk Dr Bhupinder Singh and the Dean of Cyberjaya Medical Science College University, Professor Dr Mohamed Hatta Shaharom.

Syarie lawyers are answerable to God on judgement day, court hears

KUALA LUMPUR: Only Muslims can be Syarie lawyers as they are expected to be virtuous and are answerable to God on judgement day, the High Court heard on Friday.

These are values that a Syarie lawyer must subscribe to to be effective, said Federal Territory Islamic Religious Council's lead counsel Sulaiman Abdullah.

"Syarie lawyers are expected to be virtuous. They are expected to model their conduct on Prophet Muhammad. On judgment day, they have to answer to God," he said.

Sulaiman said that a Syarie lawyer has to subscribe to these values and belief.

"If the lawyer appearing before a Syariah court does not carry those values and beliefs, the lawyer will not be able to effectively carry out his or her role," he argued Friday.

As such, the religious council was entitled to set conditions, including the requirement for Muslims to be Syarie lawyers.

And, he submitted, only the Syariah Court had the jurisdiction to take action against Muslim lawyers if they did not follow proper procedure or ethics.

KOTA BHARU, 27 Feb — PAS spiritual leader Datuk Nik Abdul Aziz Nik Mat said today that he did not ask to be born Malay.

The Kelantan Mentri Besar added that it was only by coincidence that he was born in this country.

Nik Aziz said that it did not matter what community he was born into as long as he was a Muslim.

He was responding to a statement by Tun Dr Mahathir Mohamad that he should be grateful for being born Malay because this meant that he would be Muslim.

Nik Aziz said that all races were the same, and what made a person special was that he was a Muslim.

He said that he was striving for Islam as a religion of moderation and was opposed to extremism which contradicted Islam. — Bernama go here

Guan Eng appoints Malay political secretary

KUALA LUMPUR: Zairil Khir Johari has been appointed as political secretary to DAP secretary-general Lim Guan Eng with immediate effect.

Lim said Zairil, who is the son of the late Tan Sri Khir Johari, would be assisting him with political matters at both the party and national levels.

"I am confident that with his ability and experince in various fields, he will be a positive asset to our party," he added in a statement on Wednesday. More here
